Background and purpose: One of the modern human society phenomenon is having children by the rented womb in which the owner womb woman cant keep an embryo of another person in her womb. And after the end of pregnancy period on based on presigned contract the newborn deliver to the owner embryo couple.
Materials and methods: in this case, in legal rules of the more countries like iran we didn’t have any detailed and perfect rules. So this article is going to analyze and study this case by the more consider and research in jurisprudence and legal sources to explain the legal rules like lineage, inheritance, the will and its pertaining alimony in these peoples. And meanwhile regarding of the rights of them, is prevented from without identity children birth and sometimes without parents in society.
Results: For realizing to these goals in the end of the essay some suggestions has said about making law for this case in Islamic republic of iran rules.
